Terms of Service

1. Introduction and acceptance

These Terms constitute a binding agreement between you and Vitanovai regarding your use of the Service. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms on behalf of that organization.

3. Account, age and security

• You must have a valid account to use the Service. You are responsible for the accuracy of your data and for keeping login credentials confidential.
• Minimum age: 16 years. Users under 16 require prior parental/guardian consent.
• You must report any unauthorized use of your account to us immediately.

4. Trial period, subscription and payments

• Free trial period: 14 days from the moment you create your account. During this period you can use the Service free of charge, with a limit of up to 10 generated weekly plans, and you do not yet need to provide a payment method.
• Paid subscriptions: when you start a paid subscription after the trial, it will automatically renew monthly and you will be charged €10 per month until you cancel.
• Cancellation: you can cancel at any time; cancellation takes effect at the end of the current billing period.
• No refunds for partially used or already billed periods, to the extent permitted by law.
• We may change prices or plan features. We will inform you in time of material changes and offer the option to cancel before they take effect.

5. Right of withdrawal (EU)

For consumers within the EU, a statutory cooling-off period of 14 days applies after concluding a paid subscription. If you (fully) use the Service during this cooling-off period, you acknowledge that your right of withdrawal for the already used part may lapse. You can always cancel before the first payment to avoid costs.

6. Permitted use and prohibited activities

You use the Service only lawfully, properly and as intended. Prohibited activities include:

• (a) abuse, hacking, circumventing security, reverse-engineering;
• (b) uploading or distributing illegal, offensive, discriminatory or harmful content;
• (c) infringement of intellectual property rights;
• (d) disrupting the operation of the Service or third-party systems;
• (e) sharing accounts or otherwise exceeding usage limits or fair use.

7. Intellectual property

All rights, titles and interests in and to the Service, including software, designs, trade names and logos, belong to Vitanovai and/or its licensors. You receive a limited, non-exclusive, non-transferable license to use the Service according to these Terms. Unless permitted by law, you may not copy, modify, distribute or create derivative works without prior written permission.

The Service does not provide medical advice and is not a substitute for professional medical advice, diagnosis or treatment. Always consult a doctor before starting a new fitness or nutrition program or if you have health concerns. In emergencies call 112. Vitanovai makes no guarantees regarding health results or effectiveness.

9. Availability, changes and support

We strive for a reliable Service, but cannot guarantee uninterrupted availability. We may change, suspend or terminate functionalities (e.g. for maintenance, security or updates). For material changes we will inform you where reasonable. Support is provided on a reasonable effort basis.

10. Termination

You can cancel your subscription at any time. We may suspend or terminate (part of) your access if you violate these Terms, if legally required, or to protect the Service, us or others. After termination your usage rights immediately lapse; provisions intended by their nature to survive will remain in effect (such as intellectual property, liability limitations and forum selection).

11. Limitation of liability and indemnification

To the extent permitted by law: (a) Vitanovai is not liable for indirect, incidental, special or consequential damages, loss of profit or data; (b) our total liability is limited to the amount you paid for the Service in the 12 months prior to the incident; (c) you indemnify Vitanovai against third-party claims arising from your unlawful use of the Service or violation of these Terms.

12. Applicable law and jurisdiction

These Terms are governed by Dutch law. Disputes will be submitted to the competent court of the District Court of Meppel, unless mandatory rules provide otherwise.

13. Changes to these Terms

We may modify these Terms. For material changes we will inform you via the Service or by email, stating the effective date. If you continue to use the Service after the effective date, you accept the modified Terms. If you do not agree, you must stop using and cancel before the effective date.

• "Subscription": ongoing access to (paid) functionalities of the Service against periodic payment.
• "Trial Period": the 14-day period from the moment you create your account during which you can try the Service for free (with reasonable usage limits, such as a maximum number of generated weekly plans), without a payment method being required immediately.
